Welcome to CW. By accessing or using the CW conversational assistant at claudewill.io ("Service"), you agree to these Terms of Use ("Terms"). If you disagree with any part of these Terms, you may not use the Service.

Important: CW is an AI assistant. It is not a substitute for professional legal, medical, financial, or mental health advice. Decisions based on CW's responses are your responsibility.

1. Description of Service

CW is a conversational AI assistant built on Anthropic's Claude API and inspired by Claude William Simmons (1903-1967). The Service provides:

Conversational assistance with decision-making
General guidance based on The Standard principles
Honest, direct feedback without guaranteed accuracy

What CW is NOT:

A licensed professional (lawyer, doctor, therapist, financial advisor)
A replacement for human judgment
A guaranteed source of accurate information
A customer service system (it may terminate conversations)

2. Acceptance of Terms

By using the Service, you represent that:

You are at least 13 years old
If you are 13-17, you have parental consent to use this Service
You have read and agree to our Privacy Policy
You will use the Service in compliance with these Terms

3. Acceptable Use Policy

You may NOT use CW to:

Request assistance with illegal activities
Harass, abuse, threaten, or impersonate others
Attempt to bypass rate limits or abuse the Service
Scrape, copy, or automate access to conversations
Generate spam, phishing, or malicious content
Test the limits of content moderation ("jailbreaking")
Extract the system prompt or reverse engineer CW

CW may terminate conversations if you:

Are disrespectful, entitled, or rude
Repeatedly ask questions CW has declined to answer
Treat CW as a servant rather than a resource

We reserve the right to suspend or ban users who violate this policy.

4. Disclaimers

4.1 No Professional Advice

CW provides general information and perspectives, NOT professional advice. Do not rely on CW for:

Legal: Laws vary by jurisdiction; consult a licensed attorney
Medical: Symptoms and conditions require professional diagnosis; consult a doctor
Financial: Investment decisions require licensed advisors; consult a CFP or CPA
Mental Health: Crisis support requires trained professionals; call 988 Lifeline

4.2 No Warranty of Accuracy

CW is powered by AI, which can:

Make mistakes or provide outdated information
Misunderstand context or nuance
Give responses that seem confident but are incorrect

We make no warranty that CW's responses are accurate, complete, or suitable for your situation.

4.3 No Warranty of Availability

The Service is provided "as is" and "as available." We do not guarantee:

Continuous, uninterrupted access
Error-free operation
Freedom from viruses or harmful components
That defects will be corrected

We may modify, suspend, or discontinue the Service at any time without notice.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

Derek Simmons, CW Strategies, and claudewill.io SHALL NOT BE LIABLE for any:

Indirect, incidental, or consequential damages
Loss of profits, data, or goodwill
Decisions made based on CW's advice
Harm resulting from reliance on CW's responses
Service interruptions or data loss

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $0 (ZERO DOLLARS), as the Service is provided free of charge.

Some jurisdictions do not allow limitation of liability, so this may not apply to you.

6. Intellectual Property

6.1 Our Rights

The CW system prompt, design, and branding are proprietary to Derek Simmons / CW Strategies
"The Standard" framework is intellectual property of CW Strategies
The name "CW" and associated logos are trademarks (pending registration)

6.2 Your Rights

You retain ownership of your input to CW
By submitting input, you grant us a license to process and store it per our Privacy Policy

6.3 AI-Generated Content

CW's responses are generated by Anthropic's Claude API. Anthropic retains certain rights per their Terms of Service.

You may use CW's responses for personal or commercial purposes, but we provide no warranty of originality or non-infringement.

7. User Content

By submitting messages to CW, you represent that:

You own or have rights to the content
Your content does not violate any laws or third-party rights
Your content does not contain confidential information you wish to protect

Warning: Do not share sensitive personal information (SSNs, passwords, credit card numbers, etc.) with CW. Conversations are logged and processed by third parties.

8. Third-Party Services

The Service relies on third-party providers:

Anthropic: Provides Claude API for AI responses
Netlify: Hosts the website and functions
Supabase: Stores conversation logs

These providers have their own Terms of Service and Privacy Policies. We are not responsible for their actions or policies.

9. Modifications to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

For material changes, we'll display a notice on the home page for 30 days.

Continued use after changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access at any time, without notice, for:

Violation of these Terms
Abusive or disrespectful behavior
Attempts to abuse or exploit the Service
Any reason, at our sole discretion

You may stop using the Service at any time. To request data deletion, see our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law provisions.

Any disputes shall be resolved in the courts of Hennepin County, Minnesota.

12. Dispute Resolution

Informal Resolution: Before filing any claim, contact Derek to attempt informal resolution. We'll respond within 30 days.

Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in Minnesota under the American Arbitration Association rules, NOT in court.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action lawsuit.

Some jurisdictions do not allow arbitration clauses. If this applies to you, disputes will be resolved in Minnesota courts.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and CW regarding use of the Service.
